The Law:

Felons on probation, in prison or on parole cannot vote. All former felons remain permanently disfranchised after completion of their sentence, unless they apply for a pardon from the Governor. Legislation was passed in 2001 to ease this process, but since 2003, both the number of applications and restorations has steadily decreased. In 2004, Governor Fletcher introduced a “character test” to the restoration process, requiring that applicants submit a letter describing why their rights should be restored along with three character references. In addition, the applicants must pay a $2 filing fee. Finally, both the prosecutor in the county in which they were convicted and the prosecutor in the county in which they were convicted have veto power over the application, though neither has to provide affirmative approval for an application to be successful.
